TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern your access to and use of the LUMEN LOAN mobile application, website, and related services (collectively, the “Platform” or “Services”), operated by ISHOWMESK ENTERPRISES LLP (“we”, “us”, or “our”).

By downloading, installing, accessing, or using the Platform, you agree to be bound by these Terms. If you do not accept these Terms, you must not use the Platform.

About Us

Eligibility and Account Registration

You may use the Services only if:

• you are at least 18 years old (or the legal age of majority in your jurisdiction);
• you are capable of entering into a legally binding contract; and
• you provide true, complete, and accurate information during registration and verification.

You agree to keep your login credentials secure and are responsible for all activity conducted through your account.

We may suspend, restrict, or terminate your account if we suspect unauthorized use, fraud, or breach of these Terms.

Nature of Our Services

LUMEN LOAN provides digital financial services which may include:

• account registration and customer onboarding;
• identity verification and compliance screening (KYC/AML);
• eligibility assessment and credit evaluation;
• loan application processing (subject to approval);
• repayment management, customer support, and service communications.

Important: We do not guarantee that every user will be approved for a loan. Approval and terms depend on our internal criteria, risk review, and regulatory requirements.

Identity Verification (KYC) and Compliance

To comply with legal obligations and prevent fraud, we may require you to submit and verify:

• personal identity details (name, DOB, gender, etc.);
• facial images/selfies and/or identity documents;
• employment or income-related information;
• bank account details.

You authorize us to verify the information you submit using reasonable methods, including third-party verification services where permitted by law.

Data Use and Privacy

Your personal data is processed in accordance with our Privacy Policy, which forms part of these Terms.

Loan Application, Offer, and Acceptance

If you apply for a loan:

• You submit an application through the Platform.
• We assess your eligibility using information you provide and permitted risk indicators.
• If approved, we may present a loan offer including amount, fees, interest (if any), repayment schedule, and other terms.
• A loan is created only when you explicitly accept the offer through the Platform (or other authorized method).

We may decline your application without providing a detailed explanation where doing so is necessary to comply with law, prevent fraud, protect security, or maintain business integrity.

Repayments, Late Payments, and Collections

You agree to repay all amounts due in accordance with your loan agreement and schedule. Failure to repay on time may result in:

• late payment charges where allowed by law and disclosed in your loan agreement;
• reporting to credit bureaus or relevant authorities where legally permitted;
• reasonable recovery steps, including reminders and lawful collections.

We will not engage in unlawful, abusive, threatening, or harassing recovery practices. Any debt recovery actions will be carried out in line with applicable Nigerian laws and regulatory guidance.

Fees and Charges

Any service fees, loan charges, interest, or penalties (if applicable) will be disclosed to you clearly before you accept a loan offer. You agree to review all disclosed fees carefully before confirming any transaction.

Communications and Notifications

We may contact you through:

• in-app notifications, SMS, email, or phone calls

for verification, security alerts, repayment reminders, customer support, or important service updates. You are responsible for keeping your contact details current. Failure to update your contact information may affect service delivery.

Prohibited Activities

You agree not to:

• provide false or misleading information;
• use another person’s identity or documents;
• attempt to bypass security controls or reverse engineer the Platform;
• use the Platform for unlawful purposes (including fraud or money laundering);
• interfere with or disrupt the Platform or servers;
• upload malware or harmful code;
• use automated scripts or scraping to access the Platform.

Suspension and Termination

We may suspend, restrict, or terminate access to the Platform where:

• you breach these Terms or applicable law;
• we detect fraud, security threats, or suspicious activity;
• required by regulators or law enforcement;
• you misuse the Services or harm our operations.

Termination may not remove your obligation to repay outstanding amounts, and we may continue lawful recovery actions.

Intellectual Property

All content, trademarks, logos, software, and materials on the Platform belong to us or our licensors. You are granted a limited, non-exclusive, non-transferable license to use the Platform only for personal and lawful purposes.

You may not copy, modify, distribute, sell, or create derivative works without our prior written consent.

Service Availability and Changes

We aim to provide reliable access to the Platform, but we do not guarantee uninterrupted or error-free service.

We may modify, suspend, or discontinue any part of the Services at any time for security, compliance, operational, or business reasons, including system maintenance or upgrades.

Disclaimers

The Platform is provided “as is” and “as available”. To the extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that:

• loan approval will be granted;
• the Platform will meet every user’s expectations;
• errors will be corrected immediately.

Limitation of Liability

To the maximum extent permitted by law:

• we are not liable for indirect, incidental, special, consequential, or punitive damages;
• we are not liable for losses resulting from unauthorized access caused by your failure to secure your credentials;
• our total liability relating to your use of the Platform shall not exceed the total amount of fees you have paid to us (if any) during the relevant period, except where law requires otherwise.

Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded under Nigerian law.

Dispute Resolution

If you have a complaint or dispute, please contact us first by email at ISHOWMESKLTD@GMAIL.COM. We will attempt to resolve the issue promptly.

If unresolved, disputes may be referred to appropriate dispute resolution channels or the courts of competent jurisdiction in Nigeria, unless a different procedure is required by applicable law.

Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria, including the Nigeria Data Protection Act (NDPA) 2023 and other applicable regulations.

Updates to These Terms

We may revise these Terms from time to time. Updates will be published through the Platform or official channels and will take effect from the updated effective date.

Your continued use of the Platform after updates means you accept the revised Terms.
